**LEGAL NOTICE AND DISCLAIMER** 

Please read this notice carefully before participating in any personal training, physical therapy, or coaching services provided by Daniel at Sapp Fit. By engaging in these services, you acknowledge that you have read, understood, and agree to the terms and conditions outlined below: 

**1. Assumption of Risk:** 

You understand and acknowledge that participation in any fitness program involves inherent risks, including but not limited to: muscle strains, sprains, fractures, tendonitis, joint pain, cardiovascular incidents, and other potential injuries, even if proper form and technique are followed. You voluntarily assume all risks associated with your participation in training sessions, physical therapy exercises, and coaching advice provided by Daniel at Sapp Fit.

 **2. Medical Disclaimer:** 

Daniel at Sapp Fit is a personal trainer and coach. He is not a medical doctor or a licensed physical therapist (unless explicitly stated and qualified as such). The information, advice, and exercises provided are for informational and guidance purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment. 

* You are responsible for consulting with your physician or other qualified healthcare provider before starting any new exercise program, especially if you have any pre-existing medical conditions, injuries, or concerns. * You must inform Daniel of any medical conditions, injuries, medications, or limitations that may affect your ability to participate in training or therapy. 

* If you experience any pain, discomfort, dizziness, shortness of breath, or other adverse symptoms during a session, you must immediately stop and inform Daniel. 

**3. Individual Results May Vary:

** You understand and acknowledge that individual results from personal training, physical therapy, and coaching can vary significantly based on factors such as your individual health status, commitment, effort, genetics, and adherence to recommendations. Daniel at Sapp Fit makes no guarantees or warranties regarding specific outcomes or results. 

**4. Release of Liability:

** To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue Daniel (individually and in his capacity as a representative of Sapp Fit), Sapp Fit (and its owners, employees, and agents) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury (including death) that may be sustained by you or any of your property while participating in or as a result of any services provided by Daniel at Sapp Fit, whether caused by negligence or otherwise. 

**5. Client Responsibility:

** You are responsible for: 

* Providing accurate and complete information about your health and medical history. 

* Following instructions and guidance provided by Daniel to the best of your ability. 

* Exercising within your own limits and seeking medical advice when necessary. 

* Maintaining a safe training environment. 

**6. Governing Law:** 

This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action arising out of or relating to this agreement shall be brought exclusively in the state or federal courts located in Florida. 

**7. Entire Agreement:** 

This Legal Notice and Disclaimer constitutes the entire agreement between you and Sapp Fit (and Daniel) with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written. 

**By proceeding with training, physical therapy, or coaching services with Daniel at Sapp Fit, you signify your understanding and acceptance of this Legal Notice and Disclaimer.
